Official Terms and Conditions
1. ENTRY SUBMISSION PERIOD
Entries for the 2012 Wireless Achievement Awards (the "Awards") will be accepted from 12:00:01 am Eastern Time ("ET") on Wednesday, January 19, 2012 (The "Start Date") until 11:59:59 pm ET on Friday, March 9, 2012 (the "End Date" (collectively, the "Entry Period"). Entries must be submitted during the Entry Period to be eligible for the Awards.
2. ELIGIBILITY FOR THE AWARDS
Entry is open to businesses or public sector bodies and governmental agencies who are BlackBerry® customers with at least one office located in North America (excluding Quebec), Latin America, Asia-Pacific Region or Europe. Entries must be submitted by an individual who is authorized to submit an entry on behalf of his/her organization. These Awards are subject to federal, state/provincial, and local laws. Vendors or service providers of RIM and members of the BlackBerry Alliance Program and are not eligible and will not be considered for the Awards.
3. CATEGORIES OF AWARDS
There are four (4) categories of Awards for which entries can be submitted: 1) Innovation in Public Sector; 2) Innovation in Private Sector; 3) Business Impact; 4) Attendee Choice Award.
1) Innovation in Public Sector
This Awards category is open to government and public sector organizations that
use wireless solutions in innovative ways.
2) Innovation in Private Sector
This Awards category is open to private sector organizations that have deployed
new, innovative wireless solutions to drive business productivity.
3) Business Impact
This Awards category is open to BlackBerry customers whose wireless solution has
made a significant impact on their business.
4) Attendee Choice Award
This Awards category is open to BlackBerry customers who have created their own
Business-to-Consumer applications that are available on the BlackBerry App World™
storefront.
4. ENTRY PROCESS
To participate, visit http://www.blackberryworld.com/special-programs/waa/entry-form (the "Entry Website") and follow the instructions to complete all required fields on the official entry form, including submitting any supporting documentation required for evaluation. Once you have successfully registered, you will officially be considered an eligible entrant. Provided You meet the eligibility criteria above and that You have successfully registered online during the Entry Period, You will become a participant in the Awards (a "Participant"). Participants may submit entries for multiple solutions in the same category of Awards, and may also submit entries for the same solution in multiple categories of Awards.
Participant shall be at all times responsible for the accuracy of submitted application information. RIM does not accept any responsibility for late, lost, delayed, corrupted, illegible or incomplete applications, which shall be disqualified at the sole discretion of RIM.
Participants should not include any information which is proprietary or confidential as any information submitted to RIM for the purposes and in relation to the Awards will not be treated as confidential information.
5. SELECTION CRITERIA FOR AWARD RECIPIENTS
A maximum of three (3) entries in each of the four categories will be selected as finalists. The winner in each category will be selected from the list of finalists subject to the evaluation criteria outlined below. All entries for the Awards will be reviewed and judged by a committee comprised of RIM senior staff, past winners and industry analysts (together "Selection Committee").
Innovation in Private Sector Award
Each Participant in this category will be evaluated based on the criteria below, and an overall winner will be selected from the finalists by the Selection Committee. The evaluation criteria that will be used by the Selection Committee and their corresponding weight are:
- Innovation of the Solution (50%);
- Measurable Business Impact (25%); and
- Business Case (25%) for each entry.
Innovation in Public Sector Award
Each Participant in this category will be evaluated based on the criteria below, and an overall winner will be selected from the finalists by the Selection Committee. The evaluation criteria that will be used by the Selection Committee and their corresponding weight are:
- Innovation of the Solution (50%);
- Measurable Business Impact (25%); and
- Business Case (25%) for each entry.
Business Impact Award
Each Participant in this category will be evaluated based on the criteria below, and an overall winner will be selected from the finalists by the Selection Committee. The evaluation criteria that will be used by the Selection Committee and their corresponding weight are:
- Innovation of the Solution (25%);
- Measurable Business Impact (50%); and
- Business Case (25%) for each entry.
Attendee Choice Award
The winning Participant for this category will be the Participant whose BlackBerry app receives the most votes from registered attendees of BlackBerry World™ 2012. Three finalists will be chosen by RIM's Selection Committee, and attendees will be encouraged to vote from among these finalists on their favorite BlackBerry app based on the following criteria:
- Innovation — the app is unique and innovative
- Integration — features that integrate with BlackBerry native apps
- User Interface — compelling graphics and ease-of-use
- Usefulness — would be used frequently
6. FIRST PLACE AWARDS
Four first place awards, one for each category of Awards, will be awarded to the winners (each a "WAA").
Each WAA is comprised of the following:
- Two (2) plane tickets (up to a maximum value $10,000 US each) to BlackBerry World 2012, which will be held in Orlando, Florida from May 1-3, 2012 ("BlackBerry World 2012"); two (2) separate, single occupancy hotel rooms accommodations for up to four (4) nights and five (5) days with two (2) full conference passes to BlackBerry World 2012 for representatives of the winning Participant1;
- Ten (10) BlackBerry® smartphone devices or ten (10) BlackBerry® PlayBook tablets, or a combination of both, up to a maximum of ten (10), for use by the winning Participant,2 AND
- BlackBerry Solution Services Package, comprising of:
BlackBerry Training3: Winners receive four days of any BlackBerry Training currently offered by RIM to be used onsite at your location. All four days of training must be redeemed at the same time and all training must be delivered in consecutive days. Onsite training is for a maximum of twelve (12) people. Award includes free consultation with a BlackBerry training expert to assist in identifying your training needs.
BlackBerry Certification Program4:
Five (5) BlackBerry Certification exam vouchers for redemption on any BlackBerry Certification Program series BlackBerry certification exams and five (5) BlackBerry Coach Self-Study guides selected by the winner from available offerings. The BlackBerry Certification Program is designed to validate the knowledge and skills of technical professionals working with BlackBerry products and services. Certification options are available for a variety of roles including BlackBerry solution design, BlackBerry Enterprise Server Administration and BlackBerry solution support
1 Meals and incidental costs are not included. WAA value may vary depending on flight and hotel costs. Transportation to and from departure and arrival airports is the responsibility of the Participant.
2 The Participant acknowledges and understands that use of the BlackBerry devices and/or BlackBerry tablets is subject to acceptance of the BlackBerry End User License provided with the devices and the use of the third party software is subject to the license agreement provided with the third party software, hardware, products or services (collectively, the "Third Party Information"). Your use of Third Party Information shall be governed by and subject to Your agreement with the third party, including without limitation, Your agreement to the terms of separate Third Party Information licenses, if any. Any Third Party Information that is provided with or without RIM's products and/or services is provided "as is". RIM makes no representation, warranty or guarantee whatsoever in relation to the Third Party Information and RIM assumes no liability whatsoever in relation to the Third Party Information even if RIM has been advised of the possibility of such damages or can anticipate such damages. The inclusion of Third-Party Information herein does not imply endorsement by RIM of the Third Party Information or the third party in any way. RIM does not control and is not responsible for any Third Party Information, including without limitation, the content, accuracy, intellectual property issues, compatibility, performance, trustworthiness, legality, decency, links, or any other aspect of the Third Party Information. The Participant acknowledges and understands that the BlackBerry devices will not operate without activation and that airtime services and other services are not included. The Participant acknowledges and agrees that the Participant shall be responsible for the set up and payment of any monthly airtime service fees as well as any other applicable set up or other applicable fees in order to activate the BlackBerry devices.

7. FINALIST AWARDS
Up to eight finalists, i.e. up to two in each category, will be awarded a finalist award ("Finalist Award"). Recipients of a WAA are NOT eligible to receive a Finalist Award. Recipients of a Finalist Award for the Innovation in Public Sector, Innovation in Private Sector and Business Impact Awards will be determined by the Selection Committee. Recipients of a Finalist Award for the Attendee Choice Award will be the second and third place Participants based on the voting by registered attendees of BlackBerry World 2012.
Each Finalist Award is comprised of the following:
- Two full conference passes to BlackBerry World 2012 for representatives of the winning Participant
- One (1) BlackBerry smartphone device or one (1) BlackBerry PlayBook for use by the Participant,1 AND
- BlackBerry Solution Services Package:

8. PRESENTATION OF AWARDS
The winning Participants for the Innovation in Public Sector, Innovation in Private Sector and Business Impact Awards will be determined by the Selection Committee at the offices of RIM, located at 185 Columbia Street, Waterloo, Ontario, N2L 5Z5 by March 19, 2012.
All winning Participants for these categories of Awards will be contacted by RIM via the e-mail address provided by the Participant on the application form on or about March 19, 2012, and will be announced at BlackBerry World 2012. Should RIM fail to receive an acknowledgment from a winning Participant, and confirmation of their ability to send a representative to BlackBerry World 2012, within 5 days of RIM's sending notification of winning, RIM reserves the right to withdraw the First Place Award and award it to another Participant.
The winning Participant for the Attendee Choice Award will be determined at BlackBerry World 2012. Attendee voting on the finalist for the Attendee Choice Award will begin at least one week prior to BlackBerry World 2012 and continue on-site until 5PM ET on Tuesday, May 1st, 2012. The winner will be announced at BlackBerry World 2012.
If Your app is selected as a finalist in the Attendee Choice Award category, You will be contacted by RIM via the e-mail address provided by the Participant on the entry form on or about March 19, 2012 to provide a demo video of Your app for the BlackBerry World website. You may also be asked to make a free-trial version of the app available on BlackBerry World, if it does not already exist.
Each of the winning Participants will be presented with their award at BlackBerry World 2012 (exact time and date to be determined). Winning Participants are expected to make every effort to have a senior executive available on-site, in person at BlackBerry World 2012 to accept the First Place Award and possibly participate in a video presentation on site that may be posted on event site at http://www.blackberryworld.com/ ("Awards Website").
In the event of a tie, in any of the categories, RIM may award duplicate prizes, or may select a winner, at RIM's sole discretion. The decisions of the Selection Committee are final and binding on all Participants for all aspects of the Awards.
Each winning Participant must possess required travel documents (e.g. photo identification, visa, etc) where applicable. Each winning Participant will be required to sign and return an Affidavit of Eligibility form and a Release of Liability form (together "Forms") within seven (7) days from the date sent by RIM to winning Participant. These Forms will be sent to winning Participants by email once RIM has received acknowledgement from winning Participants. Failure to sign and return these Forms within the allotted time may result in disqualification and an alternate winning Participant may be selected.
9. AWARDS PARTICIPATION
By entering the Awards, You agree, if requested by RIM, to participate in a joint press release to be released during BlackBerry World 2012, posting on the Awards Website, and other publicity and media initiatives to be determined by RIM. By entering the Awards, You grant RIM, its affiliated companies and necessary sublicensees, (collectively "RIM Companies") a global, perpetual, and royalty-free license to use Your written and/or electronic submissions, name, trademarks, trade and company names, logo designs, photographs, likeness, recorded voice, statements, biographical, personal or company information and the like (collectively, "Your Information"), captured in any form during BlackBerry World 2012, including but not limited to video, audio, and still photography, and by means of your entry into the Contest, and You grant RIM Companies the right to reproduce, copy, use, distribute, broadcast, transmit, publicly display, publicly perform, edit, modify, reformat, translate and/or publish Your Information in whole or in part, or in composite or altered character or form, in conjunction with Your own or fictitious name, in any print media, web content, CDs, DVDs, videos, or any other media in existence or yet to be developed (collectively "Medium") created by or on behalf of RIM, now known and hereafter discovered and/or developed, for the purposes of marketing and promoting BlackBerry World 2012. You agree that RIM maintains all right, title and ownership of the intellectual property rights in any Medium created by or on behalf of RIM for the purposes of marketing and promoting BlackBerry World 2012, and that the Medium shall remain the sole property of RIM, without any further consideration to You, whether or not the Medium incorporates Your Information.
You waive any right that You may have to inspect and/or approve any marketing, advertising, publicity, trade, promotional and/or other materials ("Materials") produced in connection with any of Your Information, and release any and all present or future rights You may have in the Materials and/or Your Information, including without limitation any rights to royalties or other compensation arising out of or related to the Materials and/or Your Information hereunder. You hereby waive any moral rights that You may have in the Materials and/or Your Information, effective upon the date of creation of them.
You represent that Your Information is owned or otherwise controlled by You and You represent that You have obtained all licenses and permissions necessary for the submission of Your information and use by RIM of Your Information as contemplated by this Agreement.
10. GENERAL TERMS AND CONDITIONS
10.1 Verification of Applications. The validity of any entry is subject to verification by and is at the sole discretion of RIM. Any illegible, incomplete or fraudulent entries will be rejected. Any Participant or any individual who enters or attempts to enter the Awards in a manner which is contrary to these rules or by its nature is unjust to other Participants will be rejected. All decisions of RIM with respect to any aspect of the Awards, including the eligibility or disqualification of Participants, are final, without right of appeal.
10.2 Communication of Winners. The winning Participants will be posted on the Awards Website between the dates of May 1, 2012 and May 3, 2013.
10.3 Acceptance of Award. The WAAs and Finalist Awards, save as provided for in this Agreement, must be accepted as described above and cannot be substituted for another item or exchanged in whole or in part for cash. Refusal to accept the WAA/Finalist Award may, at RIM's sole discretion, result in complete forfeiture of the WAA/Finalist Award.
10.4 Substitution of Award. In the event that, for reasons beyond RIM's control and not related to the finalist or winning Entrants, RIM is unable to award the Award/Finalist Award as described in this Agreement, RIM reserves the right to award a prize of equivalent or greater value, or, at RIM's sole discretion, the cash value of the WAA/Finalist Award, or a combination of a portion of the WAA/Finalist Award and cash.
10.5 Non-awarding of Award. In the event that no entries are received in one or more categories of the Awards, or no entry in one or more of the categories of Awards is deemed by RIM, in its sole discretion, to merit a WAA and/or recognition, RIM may, in its sole discretion, decline to award a WAA or Finalist Award in one or more of the categories of Awards.
10.6 Exclusion of Liability - General. By participating in the Awards, You agree to release and hold RIM, its advertising and promotions agencies, parent companies, affiliates, subsidiaries, officers, directors, agents, and employees, harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Awards, including, without limitations, (i) awarding, acceptance, receipt, possession, use and/or misuse of the WAA/Finalist Award obtained herein; or (ii) participation in any WAA/Finalist Award related activities, such as travelling to or from any WAA/Finalist Award related activity. The above exclusion of liability shall not apply to death or personal injury caused as a result of RIM's negligence.
10.7 Exclusion of Liability - Awards Operation. By entering the Awards, You agree to release and discharge RIM from any and all liability resulting from (i) late, lost, delayed, stolen, misdirected, unreadable, inaccurate, garbled or unintelligible communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of Awards data; (iv) any printing, typographical, administrative or technological errors in any materials associated with the Awards; or (v) any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Awards, which could limit or prevent You from entering or participating in the Awards.
10.8 Modification. RIM reserves the right to modify, cancel, terminate or suspend the Awards in whole or in part, at RIM's sole discretion, in the event of a virus, a computer bug or unauthorized human intervention or any other cause that is beyond the control of RIM that could corrupt or affect the administration, security, impartiality or normal course of the Awards.
10.9 Taxes. As RIM must report to the applicable taxing authorities the award of any Prizes which have a monetary value, each winning Participant is solely responsible for the payment of any taxes as may be required by the applicable taxing authority.
10.10 Registration Information. By completing and submitting the information requested in the course of the Awards to RIM, You are confirming to RIM that You are authorized to i) provide the requested information above to RIM; ii) that the requested information provided by You is not considered confidential by You or any third party for the purposes of RIM's internal use and to facilitate Your participation in the Awards. This may include disclosing to RIM Your social security number, social insurance number, or tax identification number to facilitate the receipt or administration of a WAA/Finalist Award.
10.11 Personal Information. By submitting Your personal information to RIM and/or its affiliates, You consent to the collection, use, and disclosure of Your personal information by RIM for the purposes of RIM's internal use, to facilitate Your participation in the Awards and to contact You, if necessary, in relation to the Awards, in accordance with RIM's privacy policy, which may be viewed at http://www.blackberry.com/legal/privacy.shtml.
10.12 Third Party Information. Your use of Third Party Information shall be governed by and subject to Your agreement with the Third Party, including without limitation, Your agreement to the terms of separate Third Party Information licenses, if any. Any Third Party Information that is provided with or without RIM's products and/or services is provided "as is". RIM makes no representation, warranty or guarantee whatsoever in relation to the Third Party Information and RIM assumes no liability whatsoever in relation to the Third Party Information even if RIM has been advised of the possibility of such damages or can anticipate such damages. The inclusion of Third-Party Information herein does not imply endorsement by RIM of the Third Party Information or the third party in any way. RIM does not control and is not responsible for any Third Party Information, including without limitation, the content, accuracy, intellectual property issues, compatibility, performance, trustworthiness, legality, decency, links, or any other aspect of the Third Party Information.
10.13 Governing Law. These Official Rules shall be governed by and construed under the laws of the Province of Ontario, Canada and the federal laws applicable therein. You irrevocably waive any objection on the grounds of venue, forum non-conveniens or any similar grounds and irrevocably consent to service of process by mail or in any other manner permitted by applicable law and consent to the jurisdiction of the courts of the Province of Ontario. You further hereby waive any right to a trial by jury with respect to any lawsuit or judicial proceeding arising or relating to these Official Rules.
